These Terms of Use (“Terms”) govern your use of the LuckOut Timer mobile application (the “App”) provided by Luanacreative LLC (“Developer,” “we,” “us,” or “our”). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. License
We grant you a limited, non‑exclusive, non‑transferable, revocable license to install and use the App for your personal, non‑commercial purposes on an iOS device (iPhone and Apple Watch) that you own or control. Your use of the App is also subject to the Apple App Store Terms of Service.
2. App Functionality
LuckOut Timer is an interval timer that assists with workout routines. It offers customizable work and rest periods, round tracking, and total work time display. Features may change as we improve the App, but we are not obligated to maintain, update, or support any specific functionality.
3. Health and Safety Disclaimer
The App provides timing functions only. It does not provide medical advice, exercise guidance, or professional training services. Always consult a qualified healthcare professional before starting any new fitness program. Use the App at your own risk.
4. No Warranty
The App is provided “as is” and “as available,” without warranties of any kind, express or implied. We do not warrant that the App will be error‑free, uninterrupted, or free of harmful components, nor do we make any representation regarding the accuracy or completeness of any information displayed in the App.
5. Limitation of Liability
To the fullest extent permitted by applicable law, Luanacreative LLC and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses arising out of or related to your use of or inability to use the App, even if we have been advised of the possibility of such damages.
6. User Obligations
You agree to:
- Use the App only for lawful purposes and in accordance with these Terms.
- Not modify, adapt, reverse engineer, decompile, or disassemble any part of the App.
- Not use the App in any way that could interfere with other users’ enjoyment or harm the functionality or security of the App.
7. Changes to These Terms
We may modify these Terms at any time. When we do, we will update the Effective Date above and, where appropriate, provide additional notice. Your continued use of the App after any modification constitutes acceptance of the revised Terms.
8. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Missouri, United States, without regard to its conflict of law principles.
9. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
